Resources for Health Care Professionals

The California Health Care Decisions Law went into effect on July 1, 2000. The California Coalition for Compassionate Care has prepared training materials for health care professionals, institutions and consumers to address these changes in the law. Each of the following documents are described below and can be downloaded from this page: 


 
Implementing the Health Care Decisions Law (A Slide Presentation)
This off-the-shelf, 50-minute slide presentation is designed for healthcare providers and educators to use to train healthcare professionals regarding the requirements of the law and the use of advance directives. Using the story of Myrtle Anderson, the presentation covers decision-making capacity, the role of surrogate decision-makers, the authority of the health care agent, the advance health care directive, oral directives, and the role of health care providers. Wendland Case

On August 8, 2001, in the case of the Conservatorship of the Person of Robert Wendland, the California Supreme Court placed new limits on situations in which life support may be withdrawn from minimally conscious patients who are not terminally ill.  A conservator who wants to withhold artificial nutrition and hydration or any other form of life support must present "clear and convincing evidence" that the patient would not want the treatment in question or that it is not in the patient's best interests to receive that treatment.

The Coalition has prepared a brief summary of the Wendland decision with several recommendations for how this should influence health care practice.

The Center for Humane and Ethical Medical Care (CHEC), Santa Monica-UCLA Medical Center, has produced a 15-minute video entitled, Who Will Speak for Robert? The Importance of Having an Advance Health Care Directive. This video is meant chiefly for lay audiences, including young adults, as a 15-minute stimulus to further discussions about advance directives. Advance Directive Forms

There are a variety of advance health care directive forms available to write down your wishes and select a surrogate decision-maker. Following are several examples and instructions on how to get them.

  • Download a simple, free form in English, Spanish or Chinese. (Thank you to Coalition member Sandy Chen Stokes, RN, MSN for translating the form into Chinese.) Please note, these forms are not copyrighted and maybe used without permission.
  • Five Wishes is a user-friendly advance directive that addresses the medical, personal, emotional and spiritual wishes of seriously ill persons. Five Wishes has been translated into 20 different languages and is now available in a bilingual form with English plus the second language side by side on the same page. Available from Aging With Dignity for $5 per copy. Click here for order information or call 1-888-594-7437.

  • The California Medical Association has an Advance Health Care Directive Kit available in English or Spanish for $5 that includes a form, wallet card and answers to commonly asked questions about advance directives. Click here for order information or call 1-800-882-1262.

  • Caring Connections has state-specific forms that can be downloaded from its website at www.caringinfo.org.

  • Senior Legal Hotline offers free legal advice by phone on this (or any other) subject to anyone over 60 in Northern California. They also have their own forms in English and Spanish, with detailed instructions and wallet cards available. Call 800-222-1753 or 916-551-2140, or visit their website at www.seniorlegalhotline.org

  • California Hospital Association's Consent Manual contains a copy of a suggested form in both English and Spanish. Manuals can be ordered by calling (800) 494-2001 or from the website, www.calhealth.org.

 Health Care Decisions Week

The California Coalition for Compassionate Care identifies a week each fall to encourage Californians to make decisions about their medical care before serious illness or injury.

Designated by the California Legislature, Health Care Decisions Week is intended to help Californians think about the kind of care they would want if they become seriously ill or incapacitated, talk with their loved ones and doctors and write down their wishes in an advance directive document.

  • October 26 - November 1, 2008 — Suggested activities your organization or community could sponsor.

National Healthcare Decisions Day

National Healthcare Decisions Day is an initiative to encourage patients to express their wishes regarding health care and for providers and facilities to respect those wishes, whatever they may be.

Join with other Americans across the country on April 16, 2008, to talk about your future health care decisions and complete an advance directive.
